1. Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of the FoodSpy app and website (foodspy.com.au). FoodSpy is owned and operated by ORYX Pty Ltd, an Australian company (ABN 70 675 046 812). By creating an account or using FoodSpy, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use FoodSpy.
2. The service
FoodSpy lets you scan or enter packaged food barcodes and receive a personalised health score based on the conditions, allergies, diets and goals you set in your profile. The service is provided for general wellness and informational purposes.
3. Not medical advice
Food is scored using product data and automated algorithms, which may be incomplete or inaccurate. FoodSpy does not provide medical advice, diagnosis or treatment, and does not replace advice from qualified health professionals.
Always check the product label for allergens, ingredients and nutritional information, and consult a health professional about your individual needs. You are solely responsible for decisions you make based on FoodSpy scores.
4. Accounts
- You must provide accurate information and keep your account credentials secure.
- You are responsible for all activity that occurs under your account.
- You must not create accounts by automated means or share your account with others.
- You must be at least 13 years old to use FoodSpy.
5. Acceptable use
You agree not to misuse the service, including by attempting to gain unauthorised access, interfering with or overloading the service, scraping or harvesting data, uploading harmful code, or using the service for any unlawful purpose. We may suspend or terminate accounts that breach these Terms.
6. Intellectual property
FoodSpy, including its name, logo, app, website and all related software and content, is owned by or licensed to ORYX Pty Ltd and is protected by intellectual property laws. Except as permitted by these Terms, you may not copy, modify, distribute or create derivative works from FoodSpy without our prior written consent. Content you submit to FoodSpy remains yours, and you grant us a licence to use it to operate and improve the service.
7. Third-party data
FoodSpy draws on public product databases and third-party data sources to identify and score products. We do not control and are not responsible for the accuracy or completeness of third-party data, and we may correct product information as we learn more.
8. Subscriptions and payments
Paid features are billed by our payment provider on the terms presented at checkout. Subscriptions renew automatically until cancelled in your account settings. If you subscribe through a mobile app store in the future, that store will manage billing and cancellation. Fees are non-refundable except where required by law. If you are a consumer in Australia, nothing in these Terms limits any rights you have under the Australian Consumer Law.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, FoodSpy is provided “as is” and “as available”, without warranties of any kind. We do not warrant that the service will be uninterrupted, error-free, or that scores and product information will be accurate or complete.
To the maximum extent permitted by law, ORYX Pty Ltd will not be liable for any indirect, incidental, special or consequential damages arising from your use of the service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the Australian Consumer Law.
10. Changes and termination
We may update these Terms from time to time and will post the updated version on this page. Continued use of FoodSpy after changes take effect means you accept the updated Terms. You may stop using FoodSpy and delete your account at any time; we may suspend or terminate access where these Terms are breached or where required by law.
11. Governing law
These Terms are governed by the laws of Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of Australia.
